These Terms of Use ("Terms") govern your use of the Upscore mobile app, the Upscore Apple Watch app, and the website at edi.dance (together, "Upscore", "we", "our"). By creating an account or using Upscore, you agree to these Terms. If you do not agree, do not use Upscore.
You must be at least 13 years old to use Upscore. By using Upscore you confirm that the information you provide is accurate and that you are responsible for any activity under your account. Keep your login credentials secure.
We grant you a personal, non-exclusive, non-transferable, revocable license to use Upscore for your own non-commercial use, subject to these Terms and to the terms of the app store you obtained Upscore from. For apps obtained from the Apple App Store, Apple's Licensed Application End User License Agreement (the "Apple Standard EULA", available at apple.com/legal/internet-services/itunes/dev/stdeula) also applies; where these Terms and the Apple Standard EULA conflict, the more protective terms for the end user apply to that subject matter. For apps obtained from Google Play, the Google Play Terms of Service apply.
Upscore offers optional paid subscription tiers (Upscore Pro and Upscore League), available monthly or annually. The following applies to all auto-renewable subscriptions purchased through the Apple App Store or Google Play:
Purchases are processed by Apple (App Store) or Google (Google Play). Refunds are handled by the respective app store in accordance with its terms; we do not separately process payments or refunds.
Upscore lets you import and analyze your own gameplay data through third-party services such as Sanbai, PhaseII, and e-amusement. Your use of those services is governed by their own terms and policies, and their availability is outside our control. You are responsible for ensuring you are permitted to access and import your own data from those services.
Upscore is an independent application. It is not affiliated with, endorsed by, sponsored by, or associated with Konami Digital Entertainment or any game publisher. "Dance Dance Revolution," "DDR," and related names, logos, song titles, and artwork are the property of their respective owners and are referenced for identification and compatibility purposes only.
Upscore is a fitness and gameplay tool, not a medical device or a provider of medical advice. Heart rate, calorie, workout, and other figures are estimates for informational purposes only and should not be relied on for any medical decision. Physical activity carries risk. Consult a qualified healthcare professional before beginning or changing any exercise program, and stop if you feel unwell. You use Upscore and engage in physical activity at your own risk.
You agree not to misuse Upscore, including by attempting to access other users' data, reverse-engineering the app except as permitted by law, interfering with its operation, uploading unlawful or harmful content, or using it to violate any third party's rights or any applicable law.
Upscore lets you upload a profile photo. You are responsible for what you upload, and by uploading it you confirm that you own it or have the right to use it, and that it does not infringe anyone else's rights.
Content standards. Do not upload anything that is unlawful, sexually explicit, hateful, harassing, violent, deceptive, or that depicts or exploits a minor. Do not upload an image of another person without their permission, or one that impersonates someone else.
Permission you give us. You keep ownership of your photo. You give us a limited, non-exclusive, worldwide, royalty-free licence to store, reproduce, and display it for the sole purpose of operating Upscore and showing the photo back to you. This licence ends when you remove the photo or delete your account, apart from copies that may briefly remain in backups or caches.
Removal. You can remove your photo at any time in the app. We may also remove content, or disable a user's ability to upload, if we believe in good faith that it breaches these Terms or applicable law — including without prior notice where the content is unlawful or harmful.
Reporting. If you believe content in Upscore is unlawful or breaches these Terms, contact us at support@edi.dance. We review reports and act on them promptly, and we have no tolerance for objectionable content.
Upscore, including its software, design, text, and original graphics, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights in Upscore except the limited license described above.
Upscore is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Upscore will be uninterrupted, error-free, or that data synced from third-party services will be accurate or complete.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of Upscore. Our total liability for any claim relating to Upscore will not exceed the amount you paid us for the service in the 12 months before the claim, or USD $50 if you paid nothing.
You may stop using Upscore and delete your account at any time from within the app. We may suspend or terminate access if you violate these Terms or if required by law. Sections that by their nature should survive termination (including IP, disclaimers, and limitation of liability) will continue to apply.
We may update these Terms from time to time. Material changes will be communicated through the app or via email. The "Last updated" date above reflects the most recent revision. Continued use of Upscore after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules, except where local consumer-protection law requires otherwise.
